In the context of enhanced efforts to prevent the abuse of freedom of contract to the detriment of creditors, organisations officially recognised as representing undertakings and organisations with a legitimate interest in representing undertakings should be able to take action before national courts or administrative bodies in order to prevent the continued use of contract terms or practices which are grossly unfair to the creditor.
Dans le cadre d’efforts redoublés pour prévenir les abus de la liberté contractuelle aux dépens des créanciers, il y a lieu de donner aux organisations officiellement reconnues comme représentant les entreprises, ou ayant un intérêt légitime à les représenter, la faculté de saisir les juridictions ou les instances administratives nationales pour mettre fin à l’utilisation de clauses contractuelles ou de pratiques manifestement abusives à l’égard du créancier.
