Member States should be able to derogate from the obligation to carry out an individual assessment where such a derogation is warranted in the circumstances of the case, taking into account, inter alia, the seriousness of the alleged criminal offence and the measures that could be taken if the child is found guilty of such an offence, provided that the derogation is compatible with the child's best interests.
Les États membres devraient pouvoir déroger à l'obligation de procéder à une évaluation personnalisée lorsqu'une telle dérogation se justifie dans les circonstances de l'espèce, compte tenu, notamment, de la gravité de l'infraction pénale alléguée et des mesures susceptibles d'être prises si l'enfant est reconnu coupable de ladite infraction, pour autant que la dérogation soit compatible avec l'intérêt supérieur de l'enfant.
