(31) A situation where conflict-of-law rules are dispersed among several instruments and where there are differences between those rules should be avoided. This Regulation, however, does not exclude the possibility of inclusion of conflict-of-law rules relating to non-contractual obligations in provisions of Community law with regard to particular matters.

Those clauses do have the qualifying conflict law provisions at the end.

The list of challenges that the system faces is long: major areas of law are incomplete; there is a need to streamline the legal system and to complete the task of harmonizing the often conflicting laws that exist between the different levels of government; the judiciary lacks independence and specialization; and the state needs to protect property rights through the clarification of contract law and the enforcement of business contracts.

It is important not to underestimate the difficulties of applying the principle of mutual recognition: ignorance of foreign law, difficulty of applying foreign law which conflicts with national law, etc. Mutual recognition is likely to lead to deregulation that is harmful to all concerned.
