In addition to the consumer’s right to terminate the contract where the trader has failed to fulfil his obligations to deliver the goods in accordance with this Directive, the consumer may, in accordance with the applicable national law, have recourse to other remedies, such as granting the trader an additional period of time for delivery, enforcing the performance of the contract, withholding payment, and seeking damages.
En plus du droit dont jouit le consommateur de mettre fin au contrat lorsque le professionnel n’a pas respecté ses obligations de livraison des biens en vertu de la présente directive, le consommateur peut, conformément au droit national applicable, avoir recours à d’autres solutions: il peut, par exemple, accorder au professionnel un délai supplémentaire pour la livraison, réclamer l’exécution forcée du contrat, suspendre le paiement et réclamer des dommages et intérêts.
