3. This Directive shall apply to the transfer of a seagoing vessel registered in and/or flying the flag of a Member State and constituting an undertaking, business or part of an undertaking or business for the purposes of this Directive, even when it is not situated within the territorial scope of the Treaty.

La présente directive est applicable au transfert d'un navire de mer immatriculé dans un État membre et/ou battant pavillon d'un État membre et constituant une entreprise, un établissement ou une partie d'entreprise ou d'établissement aux fins de la présente directive, même s'il ne se trouve pas dans le champ d'application territorial du traité.
