On the other hand, the concept of a provider should not cover the case of branches in a Member State of companies from third countries because, under Article 48 of the Treaty, the freedom of establishment and free movement of services may benefit only companies constituted in accordance with the laws of a Member State and having their registered office, central administration or principal place of business within the Community.
Par ailleurs, la notion de prestataire ne devrait pas viser le cas des succursales de sociétés de pays tiers dans un État membre car, conformément à l'article 48 du traité, la liberté d'établissement et la libre prestation des services ne bénéficient qu'aux sociétés constituées en conformité avec la législation d'un État membre et ayant leur siège statutaire, leur administration centrale ou leur principal établissement à l'intérieur de la Communauté.
