In effect, a reading of the Commission’s decision does not allow one, at first, to determine whether the authorisation which has been granted concerns only the financial compensation of the service of general economic interest or if it also extends to the mechanisms of the State aid in question, notably the PDM. As a result, given that doubts exist as to the scope of the decision, it cannot be excluded that the Commission was confronted by serious difficulties during the examination of the compatibility of the aid with the internal market.
En effet, la lecture de la décision de la Commission ne permet pas, au premier abord, de déterminer si l’autorisation qui y est octroyée concerne uniquement la compensation financière du service d’intérêt économique général ou si elle s’étend aussi aux modalités de l’aide d’État en cause, notamment au MAP..Dès lors, étant donné qu’il existe des doutes sur la portée de la décision, il ne peut être exclu que la Commission a été confrontée à des difficultés sérieuses lors de l’appréciation de la compatibilité de l’aide avec le marché intérieur.
