In its control of the proportionality of the coercive measures, the national judicial authority may ask the ECB for detailed explanations, in particular relating to the grounds the ECB has for suspecting that an infringement of the acts referred to in the first subparagraph of Article 4(3) has taken place and the seriousness of the suspected infringement and the nature of the involvement of the person subject to the coercive measures.
Lorsqu’elle contrôle la proportionnalité des mesures coercitives, l’autorité judiciaire nationale peut demander à la BCE des explications détaillées, notamment sur les motifs qui donnent à penser à la BCE qu’une infraction aurait été commise aux actes visés à l’article 4, paragraphe 3, premier alinéa, ainsi que sur la gravité de l’infraction présumée et sur la nature de l’implication de la personne qui fait l’objet des mesures coercitives.
