L'intransigeance particulière de la BEI sur les questions de contrôle public et de transparence ont même amené le Conseil Écofin à la constatation suivante, le 8 octobre 1998, qu'au vu de l'importante mission financière que le Traité et un certain nombre de règlements communautaires attribuent à la Banque européenne d'investissement, celle-ci devrait adopter une attitude exemplaire en matière de lutte contre la fraude et autoriser l'OLAF, le cas échéant, à mener des enquêtes en son sein.
