In the light, first, of the importance of safeguarding the fundamental freedom to receive information and the freedom and pluralism of the media guaranteed by the Charter and, second, of the protection of the freedom to conduct a business as guaranteed the Charter, the EU legislature was entitled to adopt rules such as those at issue, which limit the freedom to conduct a business and give priority in the necessary balancing of the rights and interests at issue to public access to information over contractual freedom.
Compte tenu, d’une part, de l’importance que revêtent la sauvegarde de la liberté fondamentale de recevoir des informations, la liberté ainsi que le pluralisme des médias garantis par la Charte et, d’autre part, de la protection de la liberté d’entreprise telle que conférée par la Charte, il était loisible au législateur de l’Union d’adopter des règles telles que celles en cause comportant des limitations de la liberté d’entreprise tout en privilégiant, au regard de la nécessaire pondération des droits et des intérêts concernés, l’accès du public à l’information par rapport à la liberté contractuelle.
