IN-CONTEXT TRANSLATIONS
Whereas the experience gained in implementing Article 57 of Regulation (EEC) No 1408/71 has revealed a shortcoming in cases where the conditions of none of the national legislations under which an activity likely to cause an occupational disease other than sclerogenic pneumoconiosis was being pursued, have been satisfied; whereas this shortcoming should be remedied by extending the scope of Article 57 (3) (a) and (b) to all occupational diseases; whereas it is consequently necessary to amend Article 60 (1) (c) and (2) and Article 94 (8) of the said Regulation;

considérant que l'expérience acquise dans l'application de l'article 57 du règlement ( CEE ) No 1408/71 a fait apparaître l'existence d'une lacune dans le cas où les conditions d'aucune des législations nationales sous lesquelles une activité susceptible de provoquer une maladie professionnelle, autre que la pneumoconiose sclérogène, a été exercée ne se trouvent satisfaites; qu'il convient de combler cette lacune en étendant le champ d'application de l'article 57 paragraphe 3 points a ) et b ) à toutes les maladies professionnelles; qu'il est par conséquent nécessaire d'adapter l'article 60 paragraphe 1 point c ) et paragraphe 2 et l'a ...[+++]


(c) if, in the case covered by subparagraph (b), an employed or self-employed person suffering from sclerogenic pneumoconiosis or from a disease determined under Article 57 (4) is not entitled to benefits under the legislation of the second Member State, the competent institution of the first Member State shall be bound to provide benefits under the legislation which it administers, taking into account the aggravation.

c) si, dans le cas visé sous b), un travailleur salarié ou non salarié atteint de pneumoconiose sclérogène ou d'une maladie qui est déterminée en application des dispositions de l'article 57 paragraphe 4 n'a pas droit aux prestations en vertu de la législation du second État membre, l'institution compétente du premier État est tenue de servir les prestations, compte tenu de l'aggravation, selon les dispositions de la législation qu'elle applique.


8. In cases of sclerogenic pneumoconiosis, Article 57 (3) (c) shall apply to cash benefits for an occupational disease the expense of which, in the absence of an agreement between the institutions concerned, could not be divided between those institutions before the date of entry into force of this Regulation.

En cas de pneumoconiose sclérogène, la disposition de l'article 57 paragraphe 3 alinéa c) est applicable aux prestations en espèces de maladie professionnelle dont la charge, faute d'un accord entre les institutions intéressées, n'a pu être répartie entre ces dernières avant la date d'entrée en vigueur du présent règlement.
