The High Court of England and Wales (Queen’s Bench Division), before which this case has been brought, asks the Court of Justice of the European Communities whether, where a product is transferred by a producer to a distribution subsidiary and sold by that subsidiary to a third party, the putting into circulation of the product occurs at the time of the transfer of the product from the producer to the subsidiary, or later, when that product is transferred by the subsidiary to the third party.
La High Court of Justice (England Wales) (Queen's Bench Division), saisie de cette affaire, demande à la Cour de justice des Communautés européennes si, dans le cas où un produit est transféré par une société productrice à une filiale de distribution et vendu à un tiers, la mise en circulation du produit intervient au moment du transfert du produit de la société productrice à la filiale ou, plus tard, lorsque ce produit est transféré par cette dernière audit tiers.
