On 22 May 2008 EPSO published in the Official Journal of the European Union (OJ 2008 C 125 A, Spanish language edition, p. 1) notice of open competition EPSO/AD/130/08 (‘the notice of competition’), held in order to draw up a reserve list of lawyer-linguists (Grade AD7) with Spanish as their main language from which to fill vacant posts in the institutions of the European Union, in particular, the Court of Justice of the European Union, the European Parliament and the Council of the European Union.

Until 30 June 2014, with regard to those officials who have been transferred to the EEAS pursuant to Decision 2010/427/EU, by way of derogation from Articles 4 and 29 of these Staff Regulations and under the conditions set out in Article 7(1) thereof, the Appointing Authorities of the institutions concerned may in exceptional cases, acting by common agreement and solely in the interest of the service, after having heard the official concerned, transfer such an EEAS official from the EEAS to a vacant post of the same grade in the General Secretariat of the Council or in the Commission without notifying the staff of the vacant post.

Until 30 June 2013, in order to take account of specific situations in a flexible manner (for example a need for future transfers of technical support tasks from the General Secretariat of the Council or from the Commission to the EEAS), a transfer of officials in the interest of the service with their post, that is without prior publication of a vacant post, from the Council or the Commission to the EEAS should also be possible in duly justified exceptional cases.

1. In order to fill vacant posts, the Director, after considering the possibilities of assigning members of staff from the Centre to those posts by transfer or promotion in level or category pursuant to the terms of Articles 32 and 33, shall initiate an external recruitment procedure on the basis of a competition in accordance with the rules referred to in Articles 4(1) and 26(2) and Annex V.

1. In circumstances of exceptional necessity, competent authorities may, if in their opinion this does not cause danger to persons, properly or the environment, issue a dispensation permitting a specified period not exceeding six months in a capacity, other than that of the radio operator, except as provided by the relevant Radio Regulations, for which he does not hold the appropriate certificate, provided that the person to whom the dispensation is issued shall be adequately qualified to fill the vacant post in a safe manner to the satisfaction of the competent authorities.

However, despite the recruitment of additional staff and the deployment of contract staff to professional border staff posts there will have to be more progress if the plan to fill all the vacant posts by the end of 2009 is to be realised.
