En l'occurrence, il s'agit i) de trois régimes d'aides fiscales sous la forme d'un crédit d'impôt de 45% du montant des investissements dépassant 15 millions € (2,5 milliards PTA) dans l'Alava, la Guipúzcoa et la Vizcaya ; et ii) des « vacances fiscales de l'année 1996 » accordées dans les mêmes provinces ainsi qu'en Navarre en faveur des entreprises nouvellement créées et prévoyant un allégement substantiel de l'impôt pendant les quatre premiers exercices où elles obtiendront des bénéfices.
The investigation concerned i) three tax aid schemes in Alava, Guipúzcoa and Vizcaya consisting of aid in the form of a tax credit of 45% of investment exceeding €15 million (ESP 2.5 billion); and ii) "tax holidays for 1996" granted in the same provinces and in Navarre for start-up firms and providing for substantial tax relief during the first four financial years in which they make a profit.
