(2) Par dérogation au paragraphe (1), dans les cas d’assurance « sur bonnes ou mauvaises nouvelles », l’assuré qui acquiert l’intérêt assurable après la perte a quand même droit à l’indemnité, sauf si, au moment de la conclusion du contrat, il était au courant de la perte alors que l’assureur ne l’était pas.
(2) Notwithstanding subsection (1), where the subject-matter is insured “lost or not lost”, the insured may recover in respect of an insurable interest in the subject-matter acquired after a loss unless, at the time the contract was concluded, the insured was aware of the loss and the insurer was not.
