Dans ce contexte, la Cour note que la Cour européenne des droits de l’homme a déjà jugé qu’une législation nationale qui accorde, de plein droit, l’autorité parentale relative à un enfant d’un couple non marié, uniquement à la mère de celui-ci n’est pas contraire à l’article 8 de la CEDH, pour autant qu’elle autorise le père de l’enfant, non investi de l’autorité parentale, à demander au juge national compétent la modification de l’attribution de cette autorité.
In that context, the Court notes that the European Court of Human Rights has already ruled that national legislation granting, by operation of law, parental responsibility for a child of an unmarried couple solely to the child’s mother is not contrary to Article 8 of the ECHR, provided that it permits the child’s father, not vested with parental responsibility, to ask the national court with jurisdiction to vary the award of that responsibility.
