En dépit de l'illégalité du régime fiscal en cause – la France ne l'ayant pas notifié alors qu’elle y est pourtant contrainte par le Traité – la Commission a limité la récupération des aides à celles qui pourraient avoir été octroyées postérieurement à la publication de la décision d’ouverture de la procédure formelle d'examen le 13 avril 2005.
Despite the unlawful nature of the tax scheme at issue (France did not notify it despite being obliged to do so under the Treaty) the Commission has limited recovery of the aid to aid granted after 13 April 2005, the date on which the decision to open the formal investigation procedure was published.
