1. Le brevet communautaire peut faire l'objet d'une action en nullité, en contrefaçon ou en déclaration de non-contrefaçon, d'une action relative à l'utilisation du brevet ou au droit fondé sur une utilisation antérieure du brevet, ainsi que d'une demande en limitation, d'une demande reconventionnelle en nullité ou d'une demande de constatation d'extinction.
1. The Community patent may be the subject of invalidity or infringement proceedings, of action for a declaration of non-infringement, of proceedings relating to the use of the patent or to the right based on prior use of the patent, or of requests for limitation, counterclaims for invalidity or applications for a declaration of lapse.
