En présence de tels éléments, il appartient à l’institution en cause de prendre les mesures appropriées, notamment en faisant procéder à une enquête administrative, afin d’établir les faits à l’origine de la plainte, en collaboration avec l’auteur de celle-ci, à défaut de quoi elle ne peut prendre une position définitive, notamment, sur le point de savoir si la plainte doit être classée sans suite ou si une procédure disciplinaire doit être ouverte et, le cas échéant, s’il y a lieu de prendre des sanctions disciplinaires.
When such evidence is provided, it is for the institution concerned to take the appropriate measures, in particular by carrying out an administrative investigation, in order to establish the facts giving rise to the complaint, in cooperation with the author of the complaint, failing which it cannot adopt a final position in particular as to whether no further action should be taken on the complaint or whether disciplinary proceedings must be opened and, where appropriate, whether disciplinary measures should be taken.
