In those circumstances, pursuant to the second subparagraph of Article 90(2) of the Staff Regulations, an implied decision to reject that complaint would be deemed to have been adopted four months later, that is to say on 28 November 2009, and so the applicant had three months and ten days within which to bring her action, namely until 10 March 2010.
