(g) The Fund, on the request of a member, may postpone the date of discharge of a repurchase obligation, but not beyond the maximum period under (c) or (d) above or under policies adopted by the Fund under (e) above, unless the Fund determines, by a seventy percent majority of the total voting power, that a longer period for repurchase which is consistent with the temporary use of the general resources of the Fund is justified because discharge on the due date would result in exceptional hardship for the member.

4. Where more than one person is responsible for the performance of any obligation under this Act, performance of the obligation by any one of them shall be deemed to be performance by all of them.

In particular, the European Community also declares that the legal instruments in force do not cover fully the implementation of the obligations resulting from Article 9(3) of the Convention as they relate to administrative and judicial procedures to challenge acts and omissions by private persons and public authorities other than the institutions of the European Community as covered by Article 2(2)(d) of the Convention, and that, consequently, its Member States are responsible for the performance of these obligations at the time of approval of the Convention by the European Community and will remain so unless and until the Community, in ...[+++] the exercise of its powers under the EC Treaty, adopts provisions of Community law covering the implementation of those obligations.

The stakeholders considered that the following approaches to stop EU-level relevant infringements would be most effective: (i) an obligation for Member States to alert other Member States about any enforcement action taken; (ii) obligation for the Member States to notify cases corresponding to defined criteria of EU-level relevance; (iii) mandatory joint enforcement actions; and (iv) mutual recognition of enforcement decisions.
