In its main arguments the Commission underlines further, that determination of normal residence is a precondition for the imposition of penalties, and that a multiple tax results in being disproportionate to the gravity of the offence which concerns the temporary movement of vehicles in a Member State, and constitutes consequently a restriction on freedoms laid down by the Treaties and impedes the free movement of the residents of the Community in infringement of Directive 83/182/EEC.
Les principaux arguments avancés par la Commission soulignent, par ailleurs, que la détermination de la résidence normale est une condition préalable à la mise en œuvre de sanctions et qu'une multiplication des taxes aboutit à une sanction disproportionnée à la gravité de l'infraction à la circulation temporaire de véhicules dans un État membre et entraîne par conséquent une limitation des libertés définies par les traités ainsi qu'une entrave la libre circulation des résidents au sein de la Communauté en violation de la directive 83/182/CEE.
