Recalls that the main responsibility for the whole process of closing the Guantánamo Bay detention facility and for the future of its inmates rests with the United States; affirms nonetheless that the responsibility for respect for international law and fundamental rights rests with all democratic countries, particularly the Union and its Member States, which together represent a community of values;

16. Calls on the Council to continue to review sanctions against specific human rights benchmarks that should include the following: the release of political prisoners and all other persons arbitrarily detained for exercising their basic human rights to free expression, association and assembly; an accurate official accounting of the numbers, whereabouts, and conditions of individuals killed, arrested and detained by the security forces, including in the recent crackdown; cessation of military attacks on civilians; and a transition to democracy; calls on the Council to help to create a positive climate for concrete political dialogue ...[+++] between the NLD, the SPDC and ethnic leaders, with the assistance of Asian countries such as ASEAN and China;

Specifically, the arrangement includes a commitment to treat detainees humanely and in accordance with the standards set out for prisoners of war in the Third Geneva Convention, which affords detainees with the highest treatment standard regardless of their status and obviates the need for status determination; an acknowledgment of the right of the ICRC to visit detainees at any time during their custody; an obligation for both parties to notify the ICRC upon transferring a detainee, in accordance with their obligations pursuant to international law; a commitment that persons transferred from the Canadian Forces to Afghan authorities will not be subject to the application of the death penalty; and lastly, a recognition by both parties o ...[+++]f the legitimate role of the Afghan Independent Human Rights Commission with regard to the treatment of detainees.
