The Court declares on the one hand that "it is not appropriate, in order to define the Community's competencies, to draw an artificial distinction between the protection of the health of the general public and the safety of sources of ionising radiation. [4]" The Court confirms on the other hand the technical competence of national safety authorities to authorise the construction or operation of nuclear facilities.
