Is it possible for the general five-year limitation period provided for under national law in Article 2224 of the Civil Code by Law No 2008-561 of 17 June 2008 to have replaced, as regards limitation periods that had not yet expired on the date when that law entered into force, the four-year limitation period laid down by Regulation No 2988/95, in the light of the derogation provided for in Article 3(3) of that regulation?

(3) After the entry into force of Directive 2004/40/EC of the European Parliament and of the Council of 29 April 2004 on the minimum health and safety requirements regarding the exposure of workers to the risks arising from physical agents (electromagnetic fields), serious concerns were expressed by stakeholders, in particular from the medical community, as to the negative impact which the implementation of that Directive would have on, on the one hand, certain industrial activities, and, on the other hand, certain medical procedures based on medical imaging, in particular magnetic resonance imaging (MRI).

(3) After the entry into force of Directive 2004/40/EC of the European Parliament and of the Council of 29 April 2004 on the minimum health and safety requirements regarding the exposure of workers to the risks arising from physical agents (electromagnetic fields), serious concerns were expressed by stakeholders, in particular from the medical community, as to the potential impact of the implementation of that Directive on the use of medical procedures based on medical imaging.

(15) As this Directive introduces for the first time harmonised rules on the provision of information on medicinal products subject to medical prescription to the general public, the Commission should assess its operation and the necessity for a review five years after its entry into force.
