Au cours de la procédure, l'Office procède à l'examen d'office des faits; toutefois, dans une action en nullité, l'examen est limité aux moyens invoqués et aux demandes présentées par les parties, sauf si les motifs de nullité visés à l'article 27, paragraphe 1, point a), aux articles 10 et 10 bis, ainsi qu'à l'article 16 après expiration du délai de deux ans prévu au paragraphe 3, sont en cause.
In proceedings before it the Office shall examine the facts of its own motion; however, in proceedings relating to a declaration of invalidity, the Office shall be restricted in this examination to the facts, evidence and arguments provided by the parties and the relief sought, except to the extent that the grounds of invalidity specified in Articles 27(1)(a), 10 and 10a and Article 16 at the end of the two-year period referred to in paragraph 3 are involved.
