In view of the above arguments, the Hungarian authorities consider that the only supportable definition of the relevant market is the whole diesel after-treatment devices market, including both DPF and DOC. According to the study prepared by an independent market research company AVL, IBIDEN’s market share in the diesel after-treatment devices market remains below 25 % both before and after the investment, thus, fulfilling the condition in paragraph 24(a) of MSF 2002.
Au vu de ce qui précède, les autorités hongroises estiment que la seule définition acceptable du marché concerné est celle d’un marché des dispositifs des véhicules à moteur diesel assurant le post-traitement, auquel appartiennent tant le DPF que le DOC. Selon l’étude effectuée par AVL, société indépendante d’étude de marché, la part de marché d’IBIDEN en ce qui concerne les dispositifs des véhicules à moteur diesel resterait inférieure à 25 % tant avant qu’après la réalisation de l’investissement, ainsi elle remplirait les conditions fixées au paragraphe 24, point a), du MSF 2002.
