In this situation the Community Patent Court should be able to make a judgment by default which would end the case unless the defendant according to the second sentence of Article 41 of the Statute lodges an objection against the judgment within one month of its notification.
Dans une telle situation, le Tribunal du brevet communautaire devra être habilité à rendre par défaut un arrêt mettant fin à l'instance, à moins que le défendeur ne fasse opposition audit arrêt dans un délai d'un mois à compter de sa notification, conformément à l'article 41, deuxième phrase, du statut.
