2. Where organisational or administrative arrangements made by the insurance intermediary or insurance undertaking in accordance with Article 13b to manage conflicts of interest are not sufficient to ensure, with reasonable confidence, that risks of damage to customer interests will be prevented, the insurance intermediary or insurance undertaking shall clearly disclose to the customer the general nature and/or sources of conflicts of interest before undertaking business on its behalf.
2. Lorsque les dispositions organisationnelles ou administratives prises par un intermédiaire d’assurance ou une entreprise d’assurance, conformément à l’article 13 ter, pour gérer les conflits d’intérêts ne suffisent pas à garantir, avec une certitude raisonnable, que le risque de porter atteinte aux intérêts des clients sera évité, l’intermédiaire d’assurance ou l’entreprise d’assurance informe clairement ceux-ci, avant d’agir en leur nom, de la nature générale et/ou de la source de ces conflits d’intérêts.
