1. In order to receive benefits under type A legislation under Article 44(2) of the basic Regulation, the claimant shall submit a claim to the institution of the Member State, whose legislation was applicable at the time when the incapacity for work occurred followed by invalidity or the aggravation of such invalidity, or to the institution of the place of residence, which shall forward the claim to the first institution.

Pour bénéficier de prestations au titre d’une législation de type A en vertu de l’article 44, paragraphe 2, du règlement de base, le demandeur adresse une demande, soit à l’institution de l’État membre dont la législation était applicable au moment où est survenue l’incapacité de travail suivie d’invalidité ou l’aggravation de cette invalidité, soit à l’institution de son lieu de résidence, qui transmet la demande à la première institution.
