Translation of "Community act " (English → French) :

Where Community legislation requires a statement by the manufacturer that fulfilment of requirements relating to a product has been demonstrated, hereinafter “EC declaration of conformity”, the legislation shall provide that the declaration is to contain all relevant information to identify the Community legislation to which it relates, and where a product is subject to requirements set out in several Community acts, it shall provide that a declaration is drawn up in respect of all those acts, mentioning the publication references of the acts concerned.

1. If the provisions of this Directive conflict with a provision of another Community act governing specific aspects of access to or exercise of a service activity in specific sectors or for specific professions, the provision of the other Community act shall prevail and shall apply to those specific sectors or professions.

9. Takes the view that the repeal of irrelevant and obsolete acts is a priority requirement with which the Commission must comply without delay; considers, however, that when Community legislation is repealed on those grounds, a Community act must be put in place at the same time to prevent Member States from regulating matters that have been deregulated at Community level;

(c) monitor and ensure the application of the provisions of this Regulation and any other Community act relating to the protection of natural persons with regard to the processing of personal data by a Community institution or body with the exception of the Court of Justice of the European Communities acting in its judicial capacity.

(d) "controller" shall mean the Community institution or body, the Directorate-General, the unit or any other organisational entity which alone or jointly with others determines the purposes and means of the processing of personal data; where the purposes and means of processing are determined by a specific Community act, the controller or the specific criteria for its nomination may be designated by such Community act.

Moreover, Article 286 of the Treaty establishing the European Communities, introduced by the Treaty of Amsterdam, lays down that Community acts on the protection of individuals with regard to the processing of data – that is the two above-mentioned directives – apply to the institutions and Community bodies and that an independent supervisory body responsible for monitoring the application of such Community acts must be established.
