3a. Without prejudice to their place of habitual residence and in order to ensure fair competition in international road transport, the individual employment contract of international drivers shall be governed by the law of the country in which, or alternatively, from which, in the light of all the factors which characterise his activities, the driver carries out, on a regular basis, the greater part of his obligation towards his employer, in performance of his contract.
3 bis. Sans préjudice de leur lieu de résidence habituelle et afin d'assurer une concurrence loyale en matière de transport routier international, le contrat de travail individuel des conducteurs internationaux est régi par la législation du pays dans lequel ou à partir duquel, compte tenu de tous les facteurs qui caractérisent ses activités, le conducteur s'acquitte, de manière régulière, de la plupart de ses obligations vis-à-vis de son employeur, dans l'exécution de son contrat .
