Without prejudice to the rights of the defendant pursuant to Articles 34, 35 and 36, either party may at any time apply to the court of origin for a variation or revocation of the EAPO on the ground that the circumstances on which the EAPO was issued have changed in the meantime, including the ground that a judgment on the substance was given dismissing the claim the enforcement of which the EAPO sought to ensure or that the defendant has paid the claim.
Sans préjudice des droits conférés au défendeur conformément aux articles 34, 35 et 36, chacune des deux parties peut, à tout moment, demander à la juridiction d'origine de modifier ou de révoquer l'OESC au motif que les circonstances dans lesquelles l'OESC a été délivrée ont changé dans l'intervalle, notamment qu'une décision sur le fond a été rendue et a rejeté la créance dont l'OESC visait à assurer l'exécution ou que le défendeur s'est acquitté de la créance.
