What is missing from this bill is the authority of the Chief of Defence Staff in the grievance process, which responds directly to Justice Lamer's recommendation; changes to the composition of the grievance committee to include a 60% civilian membership; and finally, a provision to ensure that a person who is convicted of an offence during the summary trial is not unfairly subjected to a criminal record.
Il manque ceci dans le projet de loi actuel: l'amendement sur les pouvoirs du chef d’état-major de la défense dans le règlement des griefs, amendement qui donne directement suite à une recommandation du juge Lamer; l'amendement fixant à au moins 60 % la proportion de membres civils du Comité des griefs; l'amendement visant à éviter qu’une personne déclarée coupable d’une infraction dans un procès sommaire ne se retrouve injustement avec un casier judiciaire.
