There is general consensus amongst data controllers that the current general obligation to notify all data processing operations to the Data Protection Authorities is a rather cumbersome obligation which does not provide, in itself, any real added value for the protection of individuals' personal data.

2. This Regulation is without prejudice to any obligation on a Member State to notify individual grants of aid under other State aid instruments, and in particular the obligation to notify, or to inform the Commission of, aid to an enterprise receiving restructuring aid within the meaning of the Community guidelines on State aid for rescuing and restructuring firms in difficulty(10) and the obligation to notify regional aid for large investment projects under the applicable multisectoral Framework".

In many cases, spam activities may also lead to remedies provided under general data protection legislation (e.g., breach of the obligation to notify, of the right of access, of the obligation to appoint a representative in an EU Member State, etc.) or under specific legislation (e.g., misleading advertising, fraudulent marketing, etc.).
