In the Commission’s view, the fact that it is impossible to register, in Poland, private motor vehicles (new and second-hand) which have been brought to Poland from a Member State in which traffic drives on the left, primarily by Polish nationals taking advantage of the benefit of free movement within the European Union cannot find justification in any overriding requirement of public interest in the form of ensuring road safety.
Selon la Commission, l’impossibilité d’immatriculer en Pologne des voitures particulières (neuves et de deuxième main) importées en Pologne, en provenance d’États membres dans lesquels le sens de circulation est à gauche, par des ressortissants polonais souhaitant bénéficier des avantages de la libre circulation au sein de l’Union, ne peut pas se justifier sur le fondement d’une exigence impérative d’intérêt général qui consisterait à garantir la sécurité routière.
