Dans ce contexte, la juridiction danoise a posé à la Cour de justice des CE la question de savoir si un impôt indirect perçu par un État membre (une taxe d'immatriculation), qui s'élève pour les véhicules neufs à 105 % d'une première tranche de 52.800 DKK et à 180 % du reste de la valeur imposable, peut constituer une mesure d'effet équivalent à une restriction quantitative à l'importation et, de ce fait, est incompatible avec le principe de la libre circulation des marchandises.
