There are times when it is justified to infringe on a person's rights, whether they are human rights, property rights, et cetera, but the courts have held that in such a situation there are two things that must take place in order to justify infringement of a person's rights, and the first aspect of that is the duty to consult in a thorough and comprehensive manner.
