This Article lays down the right of the proprietor of a European patent with unitary effect to prevent third parties not having his consent from supplying or offering to supply within the participating Member States any person, other than a party entitled to exploit the patented invention, with means, relating to an essential element of that invention, for putting it into effect therein, when the third party knows, or should have known, that those means are suitable and intended for putting that invention into effect.
Cet article prévoit que le titulaire d’un brevet européen à effet unitaire a le droit d’empêcher tout tiers, en l’absence de son consentement, de fournir ou de proposer de fournir, dans les États membres participants, à une partie autre que celle habilitée à exploiter l’invention brevetée, des moyens de mise en œuvre de cette invention se rapportant à un élément essentiel de celle-ci, lorsque le tiers sait ou est censé savoir que ces moyens sont aptes et destinés à mettre en œuvre cette invention.
