On the basis of the file containing the investigation officer’s findings and, when requested by the persons concerned, after having heard the persons subject to the investigations in accordance with Article 67, ESMA shall decide if one or more of the infringements listed in Annex I has been committed by the persons who have been subject to the investigations and, in such a case, shall take a supervisory measure in accordance with Article 73 and impose a fine in accordance with Article 65.

Sur la base du dossier contenant les conclusions de l'enquêteur et, à la demande des personnes concernées, après avoir entendu les personnes qui font l'objet de l'enquête conformément à l'article 67, l'AEMF décide si une ou plusieurs des infractions énumérées à l'annexe I a été commise par les personnes qui ont fait l'objet de l'enquête et, le cas échéant, prend une mesure de surveillance conformément à l'article 73 et inflige une amende conformément à l'article 65.
