We have already recommended earlier in this Report that, in the course of judicial consideration of the reasonableness of a security certificate, a special advocate should be appointed to protect the interests of the foreign national or permanent resident by having access to the confidential information on which the certificate is based and challenging non-disclosure and the reliability of the evidence.

Finally, the Committee believes that a special advocate is necessary to represent the interests of the permanent resident or foreign national during judicial consideration of a security certificate under section 78 of the IRPA.
