The competent court should assess the circumstances of the individual case and inter alia should take into account whether the alleged infringer is a small and medium-sized enterprise operating only at local level, the language of the proceedings before the European Patent Office and, during the transitional period, the translation submitted together with the request for unitary effect.
La juridiction compétente devrait procéder à une analyse au cas par cas en examinant, entre autres, si le contrefacteur présumé est une petite ou moyenne entreprise n’exerçant d’activités qu’au niveau local et en tenant compte de la langue de la procédure engagée devant l'Office européen des brevets et, durant la période de transition, de la traduction accompagnant la demande d’effet unitaire.
