During border surveillance operations at sea, Member States should respect their respective obligations under international law, in particular the United Nations Convention on the Law of the Sea, the International Convention for the Safety of Life at Sea, the International Convention on Maritime Search and Rescue, the United Nations Convention against Transnational Organized Crime and its Protocol against the Smuggling of Migrants by Land, Sea and Air, the United Nations Convention relating to the Status of Refugees, the European Conv ...[+++]ention for the Protection of Human Rights and Fundamental Freedoms, the International Covenant on Civil and Political Rights, the United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, the United Nations Convention on the Rights of the Child and other relevant international instruments.

We are not alone in that respect. The 2010 HNS convention has been targeted by the Comité Maritime International, which is the international association of maritime law national associations, and various international industry associations, as one of the priority conventions for worldwide ratification.

The CMLA is Canada's representative to the Comité Maritime International, an organization that was established in 1897 and that is primarily concerned with international maritime law and the uniformity of maritime laws, not just through conventions but through various national associations such as the Canadian Maritime Law Association.

Within DFAIT, the legal branch is the principal source of legal service and advice to the Government of Canada on an increasingly wide and complex range of public international law issues, including the establishment of Canadian maritime zones and their boundaries in conformity with international law.

I served from 1988 through 1991 as president of the Canadian Maritime Law Association, and I am currently, and have been since 1994, a member of the executive council of the Comité Maritime International, the CMI, in Antwerp, Belgium, which is the private-sector international marine law association that brings together as constituent members some 50 national maritime law associations from around the world.
