The decision in the Peugeot/Talbot case makes it clear that the exemption of distribution agreements from the general prohibition on restrictive practices as laid down in Article 85(1) of the Treaty is precluded, not only in the case of an absolute refusal to supply RHD passenger cars, but also by the imposition of substantial price supplements in comparison with LHD cars, which remove from UK and Irish consumers any advantage in buying on the Continent and which have the same effect as a refusal to supply.
