5. In addition to gains taxable in accordance with the provisions of the preceding paragraphs, gains derived by a resident of a Contracting State from the alienation of shares, participation or other rights in the capital of a company or other legal person that is a resident of the other Contracting State may be taxed in that other State if the recipient of the gain, at any time during the twelve month period preceding such alienation, together with all persons who are related to the recipient, had a participation of at least 25 per cent in the capital of that company or other legal person.
5. Outre les gains imposables conformément aux dispositions des paragraphes précédents, les gains qu’un résident d’un État contractant tire de l’aliénation d’actions, de participations ou d’autres droits au capital d’une société ou d’une autre personne morale qui est un résident de l’autre État contractant sont imposables dans cet autre État si le bénéficiaire des gains, à tout moment au cours de la période de douze mois précédant l’aliénation, détenait, de concert avec les personnes qui lui sont liées, une participation d’au moins 25 p. 100 du capital de cette société ou autre personne morale.
