On 15 November 2012, the Commission notified Sri Lanka pursuant to Article 32 of the Regulation (EC) No 1005/2008 that it considered the possibility of identifying Sri Lanka as a non-cooperating third country and invited Sri Lanka to establish an action plan in close cooperation with its services to rectify the shortcomings identified in the Decision of 15 November 2012.

The six Sri Lankan companies that submitted a request for exemption in accordance with Article 13(4) of the basic Regulation represented 69 % of the total imports from Sri Lanka to the Union during the RP. Another company from Sri Lanka claimed that had it known that the exports to the Union from Sri Lanka could be subject to the anti-dumping duty as extended to Sri Lanka as from the initiation of the investigation, it would have not withdrawn its request for exemption.
