I'm just throwing this out as a suggestion, but if we can detect the presence, in a substantial amount, of an illegal drug, whether it's an opiate or cocaine or marijuana, in the system of a person behind the wheel driving a motor vehicle, whether it's impairment or not and that's to discount any kind of casual, second-hand smoke might that not be an answer?
