Nevertheless, the fact that a grouping has a total carrying capacity greater than the fixed maximum, or cannot claim the overall exemption because of the individual capacity of the undertakings belonging to the grouping, does not in itself prevent such a grouping from constituting a lawful agreement, decision or concerted practice if it satisfies the relevant conditions laid down in this Regulation.
Néanmoins, le fait pour le groupement de disposer d'une capacité totale de chargement supérieure au maximum fixé ou de ne pas pouvoir bénéficier de l'exemption de nature globale en raison de la capacité individuelle des entreprises adhérant au groupement n'exclut pas pour autant qu'il puisse constituer un accord, une décision ou une pratique concertée licite dans la mesure où il répond aux conditions exigées à cette fin par le présent règlement.
