42. When a pension is granted to a constable on account of infirmity of mind or body, and such infirmity is certified by a medical board constituted as aforesaid to have been brought about or been contributed to by his own default, or by his vicious habits, and such constable, but for such default or habit, is entitled under this Part to a pension of a fixed amount, the Governor in Council may grant to him a less amount of pension than the said fixed amount to which he would otherwise have been entitled.
42. Lorsqu’une pension est accordée à un gendarme pour cause d’infirmité mentale ou physique, et qu’un conseil médical, constitué comme il est susdit, atteste que cette infirmité a été occasionnée par la faute ou par les mauvaises habitudes de ce gendarme, ou qu’elles y ont contribué, et que ce gendarme, n’eussent été cette faute et ces habitudes, aurait droit, en vertu de la présente Partie, à une pension d’un montant fixe, le gouverneur en conseil peut lui accorder une pension moindre que ledit montant fixe auquel il aurait par ailleurs droit.
