5a. The EIB shall not undertake any financing operation through jurisdictions which are classified as "tax havens" according to OECD standards or which are not in line with the dynamic provisions on automatic exchange of information as laid down in the Council Directive 2003/48/EC of 3 June 2003 on taxation of savings income in the form of interest payments.
5 bis. La BEI ne met en œuvre aucune opération de financement par l'intermédiaire d'États ou de territoires classés en tant que "paradis fiscaux" selon les normes de l'OCDE ou qui ne répondent pas aux dispositions dynamiques sur l'échange automatique d'informations établies par la directive 2003/48/CE du Conseil du 3 juin 2003 en matière de fiscalité des revenus de l'épargne sous forme de paiements d'intérêts.
